Practice Areas

Kim Paiva is a senior counsel in Walker's Guernsey team with 15 years' experience in private practice in onshore and offshore roles.

Kim has a broad range of expertise encompassing Banking & Finance, Corporate and Investment Funds matters, and specialises in asset financing deals, advising borrowers and lenders on matters of Guernsey law particularly in respect of aircraft and ships.

She is part of the market-leading Walkers Global Aviation Group, and advises both owners and financiers in relation to transactions involving aircraft registered or to be registered on 2-REG (Guernsey's Aircraft Registry).

Kim has ten years' experience advising on Guernsey law, largely advising lenders and borrowers in respect of financing arrangements, restructuring, real estate and acquisitions.

Having spent five years practising in South Africa's largest law firm, Kim also works with clients from South Africa on funds and private capital matters, advising clients in respect of asset protection and succession planning structures.

Recent transactions include:

  1. Acting for Apex on its acquisition of the IPES Group as well as the related financing.
  2. Acting on the acquisition of Phaunos Timber Fund Limited by Stafford Capital Partners Limited.
  3. Acting for Harbert European Real Estate Fund IV, LP on the Guernsey aspects relating to the acquisition and financing of Eastgate Shopping Centre in Scotland, Inverness.
  4. Acting for a major aviation leasing company in respect of the registration of aircraft on 2-REG and related security advice.
  5. Advising a major student accommodation fund on all aspects of Guernsey law relevant to the life of the fund, its regulation, acquisitions of properties throughout the UK, a £125,000,000 refinancing, the disposal by of the Fund of its properties for over £400,000,000.
  6. Acting the establishment of the first peer to peer commercial property lending exchange Protected Cell Company in Guernsey.

Prior to relocating to Guernsey at the beginning of 2009, Kim practised as a corporate and commercial attorney at one of South Africa's largest law firms, Edward Nathan Sonnenbergs, where she worked in the Banking & Finance and Corporate M&A teams.

On arriving in Guernsey at the start of 2009, she practised in the Business and Trust Law team at another leading offshore firm, before joining Walkers in September 2010.
